IP laws - Compliance with International Standards

In the 2012 Special 301 Report*, United States Trade Representative (USTR) announced that Malaysia has been removed from the Watch List after making significant strides, including passing copyright amendments that strengthen copyright protection, stepped-up IPR enforcement, and promulgating regulations to protect pharmaceutical test data.
Malaysia is a member of the World Intellectual Property Organisation (WIPO) and a signatory to the Paris Convention and Berne Convention which govern these intellectual property rights.
Malaysia's IP laws conform to the requirements of the World Trade Organisation’s Agreement on Trade Related Aspects of Intellectual Property Rights (TRIPS), and other international standards.
Malaysia’s IP laws are reviewed by the TRIPs Council periodically.
Malaysia is working towards WIPO’s Madrid system of trade marks by 2012.

ASEAN Patent Examination Co-operation (ASPEC)

Malaysia is a member of the ASEAN Patent Examination Co-operation (ASPEC) programme.
ASPEC facilitates the search and examination results of the participating IP offices in the assessment of patentability.
With ASPEC, the search and examination results of one participating IP office may be considered by the other participating offices.
Corresponding patents can be obtained faster and more efficiently. It also potentially reduces duplication for the search and examination work done, thereby, saving time and effort.

IP Protection in Malaysia

Malaysia has modern, comprehensive and detailed intellectual protection (IP) laws which conform to international standards.
The Malaysian Intellectual Property Corporation, also known as MyIPO, is the custodian of IP registration in Malaysia.
The agency’s role includes strengthening IP laws, establishing a strong and effective administration, and providing advisory services on intellectual property.
To further strengthen the protection of IP rights, the Government has implemented several monumental changes to the IP ecosystem:
- Setting up 21 specialised IP courts in 2007. Malaysia has the distinction of being the second country in ASEAN to set up the courts.
- Setting up of a special task force within the enforcement division of the Ministry of Domestic Trade and Consumer Affairs to spearhead IP enforcement actions.
- Legislative reforms to ensure conformity with international standards.
